Waiver & Release Form
All members, guests of members, parents of minor children, family members, and general guests hereinafter referred to Releasers, acknowledge and agree that the use of the facilities, services, equipment, or premises of HOUSE OF PAYNE is at risk of personal injury or property damage. The releasers assume full responsibility for any purpose, including, but not limited to, observation, services, equipment, training, or participation in any way. Releasers do hereby release and hold harmless the club, its directors, officers, shareholders, parents, subsidiaries, employees, independent contractors, and agents from all liability to the Releasers. Releasers signature below acknowledges that you have carefully read this waiver and release and fully understand that it is a release of liability. You expressly agree to release and discharge the club, House of Payne , and all affiliates, employees, agents, representatives, successors, or assignees, from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may other wise have to bring a legal action against the club, House of Payne for negligence, or any other personal injury or property damage or loss of action. Because physical exercise can be strenuous and subject to risk, House of Payne , urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. You (each member, guest, or participant) agree that if you engage in any physical exercise or activity, or use any of House of Payne amenities on the premises or off premises at a sponsored club event, you do so entirely at your own risk. This includes, without limitation, your use of the locker room, parking area, sidewalk area, or any equipment in the House of Payne, facility and your participation in any activity, class, program, or instruction. You agree that you are voluntarily participating in these activities along with the use of these facilities and premises and assume all risks of injury, illness, damage or loss or theft of any personal property. This waiver and release of liability includes, without limitation, all injuries to you which may occur as a result of (a) your use of any exercise equipment, products and House of Payne amenities, (b) the sudden and unforeseen malfunctioning of any equipment (c) our instruction or supervision, and (d) your slipping and/or falling while in House of Payne or on the premises, including adjacent sidewalks and parking areas regardless of negligence. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of the club, its agents and employees. If any portion of this release from liability shall be deemed by a court of competent jurisdiction to be invalid, then the remainder of this release of liability shall remain in full force and effect and the offending provision or provisions severed here from. By accepting this release, I acknowledge that I understand its content and that this release cannot be modified orally.
